Subscriber agrees to absolve REDTROUT.com, its directors, officers, shareholders, agents, employees, and its other subscribers from any and all claims, liabilities, damages, or expenses including attorneys fees, arising out of or resulting from all use of Subscriber's account or Subscriber's website, whether authorized or not. Subscriber agrees to indemnify REDTROUT.com and hold REDTROUT.com harmless against liability for any and all claims arising from use of Subscriber's account.

The system and services of REDTROUT.com may only be used for lawful purposes and in a manner in which REDTROUT.com believes, in its sole discretion, to be consistent with the rights of other REDTROUT.com subscribers and third parties. Transmission, distribution or storage of any material in violation of any applicable law or regulation is prohibited. This includes, without limitation, material protected by copyright, trademark, trade secrets of other intellectual property used without proper authorization. Violation of the law shall also be construed to mean the use of any material that is defamatory, judged obscene, constitutes a threat, or violates export control laws. Use of REDTROUT.com as a mail drop, platform, or website for the purposes of evading laws or regulations, or for the purposes of engaging in fraud is also specifically prohibited.

Subscriber agrees to reimburse REDTROUT.com for all legal, personal, and processing costs associated with assisting law enforcement in the investigation of illegal activities relating to the Subscriber's account.

REDTROUT.com will make reasonable efforts within its abilities to assure that the service is available 24 hours a day, seven days a week. However it is possible that service interruptions will occur. REDTROUT.com will attempt to provide subscribers with electronic notification if an interruption of service is anticipated.

REDTROUT.com makes no warranties of any kind, whether expressed or implied for the services provided. REDTROUT.com does not and cannot control the quality, content or accuracy of information available through its system or over the Internet in general. Use of any information obtained from the Internet via REDTROUT.com is at your own risk. REDTROUT.com specifically denies any responsibility for the accuracy of information obtained through its services from the internet. REDTROUT.com assumes no liability for any damages incurred by the use or downloading of information from the Internet.

REDTROUT.com is not responsible for any damage resulting from the use, loss of use, or misuse of its service. REDTROUT.com will not be responsible for any damages you suffer. This includes, but is not limited to, loss of data resulting from delays, non-delivery, mis-delivery, or service interruption of any cause.

Subscription to REDTROUT.com is not intended to be for unlimited access,and is expressly not a dedicated connection. An inactivity time-out has been engineered into the system to ensure fair access to all subscribers. Redtrout.com limits subscribers to a total of 150 hours usage per month. Using more than the allotted 150 hours will result in cancellation of this account without refund of any prepaid fees. Multiple simultaneous login to Redtrout.com using the same username and password constitutes fraud and will be result in cancellation of the account without refund of any prepaid fees.

Client understands that prepayment for Redtrout.com services is due on the first of each month. Client understands that they must notify Redtrout,Inc prior to the start of a new billing period if canceling Redtrout.com Internet Service. Client agrees to be held responsible for and will pay for services until the beginning of the next billing period after giving notification of cancellation.

By using Redtrout.com Internet Services client user agrees to all the terms and conditions listed on the home pages of Redtrout.com and will abide by these terms and conditions while using Redtrout.com Internet Services

REDTROUT.com will not be held responsible for any telephone charges (long distance, local long distance, message units, or tolls) that may result from using the service. The following violations of either law or "netiquette" are considered grounds for immediate termination of an account with REDTROUT.com. These violations put us at risk with our providers and can potentially render REDTROUT.com vulnerable to legal action from others within the industry.

Sending unsolicited email messages, including without limitations, "spam", commercial advertising, and informational announcements, is explicitly prohibited and will result in account suspension or cancellation without refund of any prepaid fees. An email message is considered "spam" if the recipient's personal identity and context are irrelevant because the message is equally applicable to many other recipients AND if the recipient has not verifiable granted deliberate, explicit and still-revocable permission for it to be sent; AND the transmission and reception of the message appears to the recipient to give disproportionate benefit to the sender.

REDTROUT.com reserves the right to refuse accounts. Subscriber's account and rights to use the services and systems of REDTROUT.com are not transferable without the consent of REDTROUT.com.

These terms and conditions supercede all previous representations, understandings, or agreements and shall prevail, notwithstanding any variance with terms and conditions of any order previously submitted. Non-enforcement of any section of this Agreement does not constitute consent, and REDTROUT.com reserves the right to enforce this Agreement at its sole discretion.
